An Indiana doctor has now been fined $3,000 for not reporting the abuse experienced by a 10-year-old girl from Ohio who had been raped by an illegal immigrant. The young girl was allegedly unable to have the procedure done in her own state after Roe v. Wade was repealed, per the Daily Mail.

The report notes that Dr. Caitlin Bernard was not fined for carrying out the procedure, but that she was fined $3,000 for speaking about the case with the media, with the state’s Republican attorney general suggesting that she was being “brazen in pursuit of (her) own agenda.”

Ohio almost completely banned abortions immediately after Roe v. Wade was overturned, outlawing abortions after the sixth week of pregnancy. Conversely, Indiana allows abortions up to 21 weeks and six days. While there is a law in Indiana that would completely ban abortions across the state, it is currently being challenged in the courts and has not taken full effect, per the report.

Bernard became emotional when she learned that her medical license would not be revoked for sharing confidential information about the case. However, the Medical Licensing Board said that she did not sufficiently abide by the privacy laws by not reporting details about the girl’s treatment of abuse. While Indiana’s attorney general had suggested that she have license revoked, board members decided to instead fine her $3,000.

Bernard has consistently defended her actions by saying that she did not violate any of the reporting requirements, going on to say that the rape of the 10-year-old girl was already being investigated in Ohio before she released any information on the case. Her lawyers also mentioned that Bernard did not violate any privacy laws in the rape case, per the report.

Some at the time suggested that Bernard had somehow made up the story about the girl, until it was revealed that a 27-year-old man was charged with rape in Columbus, Ohio.
